By enrolling in Effortless guidance services, you agree to the following terms. These terms may be updated periodically, so please review them regularly.

OVERVIEW

Effortless provides psychological and professional guidance aimed at fostering personal and professional growth. Active participation is essential for success in both group and private mentoring services.

PRIVATE GUIDANCE

Private psychological guidance is designed to address individual challenges with tailored support, offering a deep dive into personal or professional areas. The Service Provider acts as a facilitator, but the client is responsible for their actions and decisions. 

Sessions can be scheduled as needed and are structured to discover road blocks, help clients set goals, break down obstacles, and move toward their desired outcomes. Private psychological engagement requires openness, commitment, and active participation to be effective.

GROUP GUIDANCE

Group business guidance is a collaborative environment where participants can engage in workshop-style sessions that include Q&A, reflection, and brief one-on-one moments within the group.

Group guidance provides conceptual education, but it’s the responsibility of each participant to implement the guidance shared.

 

Participants are expected to engage fully, participate in group discussions, and contribute to a supportive atmosphere. Each participant must maintain confidentiality and respect the privacy of others in the group. 

PROFESSIONAL RELATIONSHIP

The Client acknowledges that psychological and business guidance is not a substitute for consulting, therapy or medical treatment. If you are under the care of a mental health professional, please inform both your therapist and the Service Provider. Both group and private guidance require participants to be fully committed to their personal and business growth. Any decision made during or after guidance is the responsibility of the Client.

RESULTS DISCLAIMER

Guidance outcomes vary based on individual effort and engagement. Effort and commitment from both the Service Provider and Client are critical to achieving the best results, but specific results cannot be guaranteed.

PAYMENT & BILLING

Fees must be prepaid for a minimum of three months, and subsequent payments must be made within 72 hours before the next billing period. Failure to make timely payments may result in cancellation of engagement.

CANCELLATIONS & NO-SHOW POLICY

Cancellations must be made at least 24 hours in advance. Any missed sessions will not be rescheduled or refunded. If the Client is unable to attend a session, they may designate someone else to attend, subject to the Service Provider’s approval.

REFUND POLICY

Refunds are available only within 24 hours of purchase, minus a transaction fee. If sessions are completed earlier than expected, unused sessions may be refunded at the Service Provider’s discretion.

SESSION RESCHEDULING

Sessions may be rescheduled at the discretion of the Service Provider. If a session needs to be rescheduled, the latter will provide at least 24 hours' notice.

PRIVACY & CONFIDENTIALITY

The Client agrees to maintain confidentiality and will not share any personal or group-related information discussed during sessions.

LIABILITY & HEALTH

Clients are responsible for their own physical, mental, and emotional well-being. The Service Provider is not liable for any decisions or actions taken outside of the guidance process.

PROGRAMME MODIFICATIONS & EXTENSIONS

If desired results are not achieved or were reconsidered in the agreed timeframe, clients may extend their program or upgrade to additional sessions.

CONFIDENTIALITY

Confidentiality principles bind the guidance relationship, and all information the Client shares is protected. All parties recognise that the Service Provider-Client-Group relationship is not legally confidential, but the Service Provider will maintain confidentiality as outlined in relevant professional standards. 

Confidential information includes information disclosed in writing and marked as confidential, or that reasonably should be understood as such. The Client pledges to uphold the confidentiality of fellow group members and refrain from sharing any information discussed within the Group with individuals outside of it. The Client also agrees not to disclose any content or information pertaining to the group sessions or its members to anyone outside the Group.

While the Service Provider encourages confidentiality among group members, the Service Provider cannot monitor or guarantee the enforcement of confidentiality agreements between participants. Group members are responsible for maintaining the confidentiality of any sensitive information shared within the group.

EXCEPTIONS TO CONFIDENTIAL INFORMATION

Certain situations do not fall under confidentiality, including publicly known information, information obtained from third parties, legal requirements, imminent risk of danger or harm, and illegal or criminal activities.

COMMUNICATION & ENGAGEMENT TECHNOLOGY / RELEASE OF INFORMATION

Sessions will be conducted online, and participants should ensure they are in a private, quiet space during each session. The Service Provider will respond to emails within 24 hours, excluding weekends and holidays. The use of technology (e.g., Internet, mobile phones) in guidance interactions is assumed appropriate if accepted by the Client.

Written permission is required if the Client wishes the Service Provider to speak to someone outside their interactions. The Service Provider will not disclose the Client's name as a reference without written permission.

The Service Provider must obtain the Client’s and the Group’s written consent before audio or visual recordings of guidance sessions. The Service Provider will not publicly reference the Client's relationship without prior approval. All parties acknowledge that corporate names, trademarks, and ownership rights shall remain the sole property of each, regardless of any authorisation to use names or logos.

For training and maintaining professional credentials, the Client agrees to share limited information with credentialing staff members.

 

Audio recordings may be required for professional assessment, but identifying personal details will be removed or altered to protect the Client's identity. The Group will be advised before audio recording the session. The Service Provider will not record video calls.

Guidance discussions may be shared anonymously and hypothetically for training, supervision, and education purposes, with no personal details disclosed that could identify the Client.

RECORD RETENTION POLICY

All records related to the guidance engagement, including communications and digital documents, shall be retained for the duration of the guidance relationship. After the retention period, all parties may securely dispose of or delete these records to protect sensitive information and confidentiality.

INTELLECTUAL PROPERTY & COPYRIGHT

Effortless holds exclusive rights to its name, logo, and trademarks, which are protected by trademark laws. Unauthorised use or display of these is prohibited.

  • Guidance Materials: Any materials or content produced during guidance sessions are the intellectual property of the Service Provider. The Client cannot use or distribute these materials without written consent. The Client is granted a limited license only for the purposes of professional engagement.

  • Website Materials: All materials on the website (e.g., text, images, logos) are protected by copyright laws. Users are allowed limited, non-transferable use for personal, non-commercial purposes, but cannot reproduce or distribute the materials.

USER-GENERATED CONTENT

Users may submit content (like reviews or comments) to the website. By doing so, they grant the Service Provider a worldwide, irrevocable, royalty-free license to use, modify, and distribute that content for any purpose.

STATUS

The Service Provider is an independent contractor, and this Agreement does not create an employer-employee relationship or partnership between the Service Provider and the Client.

NO GUARANTEES OR WARRANTIES

The Service Provider makes no guarantees or warranties regarding the professional services. All services are provided as-is, and the Client assumes the risks related to outcomes and performance.

The Client is responsible for their well-being and decisions resulting from the guidance process. The Service Provider is not liable for any effects of the services.

LIMITATION OF LIABILITY

The Service Provider is not liable for any special, incidental, or consequential damages arising from the guidance services. The Service Provider’s liability is limited to the amount the Client paid for the services.

 

The Service Provider is not responsible for delays or hindrances caused by the Client’s actions or external circumstances. The Service Provider is not liable for group members' actions or behaviour in group sessions.

INDEMNIFICATION

The Client agrees to indemnify and hold the Service Provider harmless for any losses resulting from legal actions due to the Client’s use of the Service Provider’s work.

EXCEPTIONS TO LIABILITY LIMITATION

The Service Provider’s liability is not limited in cases of death, personal injury, fraud, or fraudulent misrepresentation.

DISPUTE RESOLUTION

If a dispute arises, both parties agree to attempt mediation within 30 days. If mediation fails, legal action can be taken, and the prevailing party can recover attorney’s fees and court costs.

GOVERNING LAW

The Agreement is governed by the laws of England and Wales, and any legal disputes will be settled in the courts of England and Wales.

AMENDMENTS

The Service Provider reserves the right to modify the Terms at their discretion, but changes affecting fees or guidance sessions will be communicated. The most current version of the Terms will always be available on the website.

AGREEMENT ACKNOWLEDGMENT

By engaging in personal and professional guidance services, the Client acknowledges and agrees to the Terms and Conditions. The Client must review and accept these periodically, as the Service Provider can update them without prior notice.

The Terms and Conditions outline the relationship, responsibilities, and rights of both the Service Provider and Client, ensuring clear understanding and protection for both parties.
